RE: The tariff classification of steel chain from China.

Dear Ms. Davenport:

In your letter dated September 18, 2012 you requested a tariff classification ruling on behalf of your client, Dolgencorp, Inc.

The items under consideration are described as Flower Pot Chain, SKU #10989601, and Extender Chain, SKU #10989701, both made of steel. Representative samples were included with your submission and will be returned as you requested.

The Flower Pot Chain consists of 3 individual chains, 18 inches in length, and 3 ā€œSā€ hooks in a blister pack. The chains have 25 links, each link measuring approximately 2.15 centimeters and attach to the planter by inserting the ā€œSā€ hooks through holes in the top of the flower pot. The other end of the chains attach to a hook that hangs from the ceiling.

The Extender Chain is 36 inches in length and includes 28 chain links, each link measuring approximately 3.7 centimeters. The chain is used to hang planters from a ceiling hook and also comes in a blister pack.

You suggest classification of the Flower Pot Chain and the Extender Chain in subheading 7315.12.0080, Harmonized Tariff Schedule of the United States (HTSUS), which provides for chain and parts thereof, of iron or steel, articulated link chain and parts thereof, other chain, other. However, the subject chain does not contain segments united by joints such as pins and therefore would not be considered articulated chain.

The applicable subheading for the Flower Pot Chain and the Extender Chain will be 7315.89.5000, HTSUS, which provides for chain and parts thereof of, iron or steel, other chain, other, other. The rate of duty will be 3.9 percent ad valorem.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
